Martial law in the United States refers to times in United States history in which a region, state, city, or the whole United States was placed under the control of a military body. On a national level, both the US President and the US Congress have the power, within certain constraints, to impose martial law since both can be in charge of the militia. In nearly every state, the governor has the power to impose martial law within the borders of the state.^[1] In the United States, martial law has been used in a limited number of circumstances, such as New Orleans during the Battle of New Orleans; after major disasters, such as the Great Chicago Fire of 1871, the 1906 San Francisco earthquake, or during riots, such as the Omaha race riot of 1919 or the 1920 Lexington riots; local leaders declared martial law to protect themselves from mob violence, such as Nauvoo, Illinois, during the Illinois Mormon War, or Utah during the Utah War; or in response to chaos associated with protests and rioting, such as the 1934 West Coast waterfront strike, in Hawaii after Japan’s attack on Pearl Harbor, and during the Civil Rights Movement in response to the Cambridge riot of 1963.

Legal basis

The martial law concept in the United States is closely tied to the right of habeas corpus, which is, in essence, the right to a hearing and trial on lawful imprisonment, or more broadly, the supervision of law enforcement by the judiciary. The ability to suspend habeas corpus is related to the imposition of martial law.^[2] Article 1, Section 9 of the US Constitution states, “The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.” There have been many instances of the use of the military within the borders of the United States, such as during the Whiskey Rebellion, President Lincoln’s suspension of habeas corpus in 1861 in order to arrest of one-third of the Maryland state assembly, and in the South during the Civil Rights Movement, but those acts are not tantamount to a declaration of martial law.^{[citation needed]}

In United States law, martial law is limited by several court decisions that were handed down between the American Civil War and World War II.^{[citation needed]} In 1878, Congress passed the Posse Comitatus Act, which forbids US military involvement in domestic law enforcement without congressional approval.

Throughout history, martial law has been imposed at least 68^[3] times in limited, usually local areas of the United States. Martial law was declared for these reasons: Twice for war or invasion, seven times for domestic war or insurrection, eleven times for riot or civil unrest, 29 times for labor dispute, four times for natural disaster and fifteen times for other reasons.^[3] Habeas corpus was suspended federally only once in 1863 during the Civil War.^[3]

Based on opposition by Congress, individual state Governors, law enforcement community, and absence of clarity on who even introduced these changes, the ‘Enforcement of the Laws to Restore Public Order’ law was repealed on January 28, 2008, (based on Sen. Pat Leahy’s S. 513 proposal to repeal) and the previous Insurrection Act was restored. I cannot make this any clearer than this. We are not at war, not getting invaded, have not had a house fall on our heads. There are no legal grounds for this to happen in our country in any state. The act of blocking people from their daily lives, jobs, access to healthcare, education, caring for elderly parents, obtaining food, voting are all getting unjustly violated. Hiring ICE and placing National Guards to roam the streets hunting down innocent Americans isn’t what they were trained to do. They are there in case of actual physical attacks by our enemies.

I have waited a while to come back and do a blog on what is happening to the American people, immigrants, poor, disabled, black, trans and gays. I have waited and held my tongue so as not to make enemies, I have watched as he has wasted tax dollars on crap nobody wants, needs, tax cuts the rich do not deserve. He has destroyed the economy, jobs and healthcare, rights for everyone. His delusions and behaviors clearly indicate he is mentally unfit for office, is a criminal, desperate to distract, con, deflect, so he does not go to jail for raping little girls.

We tried to warn those who insisted on voting for him not because it was a dem thing. It was to protect all of us. On both sides we tried to protect everyone from this monster. The songstress Rhianna has a song about Diddy called Monsters. That could also apply to Trump. He too is a monster and he too is filling our heads. The difference is that Diddy went to jail and Donald is yet to end up there.

There are witnesses to his behaviors who can testify against him, they are in jail, he is still a free man. What is wrong with that picture folks? He does not have magic powers over us, cannot dictate anything. He is not a king, nor a ruler. he might need to be smacked upside the head with one, true, but he is not any of the above. He is a rapist, con man and thief, cheater, liar, puppet of the Kremlin.

He cannot dictate to the Supreme court; no president has the right to do that to avoid prosecution. He cannot abuse our military or people. We are not nazi Germany, and do not do concentration camps. Our kids, parents, sick and disabled, women, are all at risk because of him and his inept and just as corrupt group of puppets working for him. Not us, or you, but for him.

Those who were clearly maga or Trumpers of course tried to sour the moment to be met with yells of “GO HOME,”

How can anyone take him seriously? No president has ever ordered a parade in his honor. Nor has anyone demanded National Guards be sent up to protect the magas when there was no war taking place. Many have speculated he is in the throes of dementia. It does not take Freud to see his actions are textbook. Those who clung to the boat when the Titanic were going down did the same thing, only the iceberg won. It took the rich down with the ship and did not protect any of them wealthy or not. Those who managed to see their faits went for the lifeboats while they could, and while some still died, a few survived.

The question is this, with the world joining in the protests, wanting to help those of us who chant Obama today, there are others willing to take us down while we are not looking. There is no grounds for martial law, we are not at war, there is not a national emergency, no typhoons or hurricanes or tornadoes. No volcanos erupted taking out cities. Wag the dogs to distract from unlawful bills to rob innocent people of their rights and civil liberties, money they paid into to receive at retirement, convicts that should be behind bars, not released or pardoned for attacking federal capitols. Social programs many need to survive, stripped of funding.

No matter what side of the fence you are on, at some point you must say enough Donald. It is time to hand over the reins to those willing to care for the people, all of them and their families and needs. You cannot be abused, harmed, killed for choice, DNA, disability, age, size, color, religion. Do not let anyone tell you your rights are not your own. Attacking those who speak up, out, who dare uncover inconvenient truths, some don’t like or want exposed. You may not be silenced, jailed, sent off to internment camps to behave, taught a lesson, abused or killed. This is not a lie, this is cold, hard, fact. It is the truth.

Internment camps have been around for years, once called black houses, in the Cheney days, much like the Patriot Act, also was used silence the masses. We are not here to incite riots, or violence. We do not condone acts of violence against others, including POTUS. Instead, we will challenge them in the media, demanding rules of law be upheld and that includes following those rules to protect the rights and civil liberties for all people. We will uncover inconvenient truths and expose them, and if you have nothing to hide, there are no laws broken. Those with much to hide, trying to avoid federal jail time, won’t like it, try to silence us, Bring it Donald.

We the sheep, people, stand hand in hand side by side, with our voices loud, proud, refusing to kowtow to your illegal, unethical, amoral, attempts to silence the masses. No amount of yelling over us or trying to lie, create stupid lies, attack us for what we may or may not be. For the record, sheep love men. We won’t wear the duct tape on our mouths, cleanse our music or literature, burn books, or turn in those who are here legally. We uphold the rules of law, civil rights, of all people. We are speaking out and up about the lack of due process for those held for maybe being seen as undocumented.

College universities and students, sheep see you and hear you. We support you. We stand with you, the Ukraine, those who were grotesquely attacked, I see you and hear you.

We do not elect kings, allow for anyone person to rule the public with illegal and amoral acts. We elect those who are honorable and follow the rules of law, uphold the constitution, rights and civil liberties for all, not just a few. We do not accept bribes from anyone who could expect us to accept horrific acts against us or others. We do not tolerate the personal attacks of those suffering from inhuman illness or disabilities. We don’t steal from children suffering from cancer, block them from obtaining food at schools, books that open their minds to all things possible for the future. We do not silence people like AOC and Bernie who are also acting as your voices, waking you up to the hard truths happening in front of us.

Donald, we are putting you on notice, we are watching you, will out your actions, legally, ethically, morally. You have a choice, step down, or face impeachment. There is no try. No more excuses, threats, you won’t put us in jail. We are not breaking laws, we are using free speech for all to be seen and heard. Your attempt at silencing the masses is neither legal nor original. Others before you tried and failed.

Getting rid of judges who can put you in jail won’t keep you out of jail, it will only add further reason to charge you with felonies designed to mask, hide, remove those who can and will testify against you. Trying to hide theft from other’s social security or other financial programs they have paid in to, cannot be justified. Just like you cannot steal a jet from Qutar and expect to hide it in your library for later. This isn’t a tin of caviar from Putin.
